Please read these Terms & Conditions before placing your order so you understand how we do business. If you have any questions please contact us immediately. Heritage PhotoArt reserves the right to make changes to Prices, Terms and Conditions at any time without notice before acknowledgement of your quoted order. Customer submission of a signed Order Form to Heritage PhotoArt, LLC acknowledges their understanding and agreement to abide by all these Terms & Conditions.
Quality: Customer satisfaction and the quality of our work is the first priority of Heritage PhotoArt, LLC. However in the unlikely event that a print problem somehow gets past our quality control system, Heritage PhotoArt Customer Service will make every possible attempt to fully satisfy the customer’s requirements. Any PhotoArt print proven to be misprinted or be of degraded quality after comparison to the customer approved proof, will be reprinted and shipped at no cost to the customer.
Payments by American Express®: A signed PhotoArt Order Form must accompany the photos you send us to work from. When your PhotoArt proof is ready to send, all the Art Fees as quoted to you will be charged to your credit card. After return receipt of your signed approved customer proof, Heritage PhotoArt, LLC will immediately print your full order, ship and charge the balance due on your order.
By Personal or Business Check: To start work on your Heritage PhotoArt™ a signed PhotoArt Order Form and a check for all the Art Fees as quoted to you must accompany the photos you send us to work from. You must include the balance due with the return of your signed approved customer proof. Heritage PhotoArt, LLC will immediately print and ship your complete order.
Customer Errors: Heritage PhotoArt, LLC makes every attempt to avoid making any kind of error in historical image use, spelling or punctuation. However, it is the sole responsibility of the customer to proof the correctness of all images and to read carefully all text and dates on their proof for any spelling or punctuation errors. There is no charge for correcting any kind of error on a proof. However once a job is printed, no refunds are available for any kind of error in historical image use, spelling or punctuation. The customer will be charged for any reprint printing to correct the error.
Order Cancellation/Refunds: Regrettably if an order must be canceled, Heritage PhotoArt, LLC will charge only for work that has been accomplished up to the time of job cancellation. If a job is canceled before our first proof is sent, some remainder of the customer’s deposit or art fee may or may not be refunded. If a job is canceled after our first proof is sent to the customer, no refund of the customer’s Art Fee will be refunded. After the customers proof and printing approval, no refunds of any kind will be made available even if any kind of image or typographic error exists in the job.
Copyrights: Heritage PhotoArt™ obeys all United States copyright laws that protect photographers' and artists' work. Heritage PhotoArt™ can not reproduce any copyright marked (example: “©” date, name) image unless the customer includes a signed Reproduction Permission Form with that particular image. The customer guarantees that all other unmarked images supplied by them for reproduction to be owned by them, the customer, and will indemnify Heritage PhotoArt™ from any misused reproduction or copyright violation(s). Heritage PhotoArt™ reserves the right to refuse use of customer image(s) that we believe may infringe copyright, are discriminatory, hateful, or that may be in violation of any other laws.
Customer Images: All customer CDs, DVDs, image and photo copies will be returned with the shipment of their finished limited edition PhotoArt™ prints. In the case of any customer’s original photographs and important documents, those will only be returned by Registered United States Mail that requires a personal signature of receipt. Heritage PhotoArt, LLC pledges to never share, sell or otherwise allow reuse of any customer supplied image(s) by anyone else.
Liabilities: Under no circumstances will Heritage PhotoArt, LLC be held liable for any customer’s or other’s losses, damages, or personal duress resulting from the use of our services for any reason. This includes, but is not limited to PhotoArt™ delivery delays for any reason, issues of quality, shipping damage, or customer errors. Customer reimbursement for non-shipment of any order for any reason will be at the sole discretion of Heritage PhotoArt, LLC and in any event will not exceed customer deposits or payments.
The customer agrees to indemnify or hold Heritage PhotoArt™ blameless and harmless against all losses, damages, legal expenses, violations of copyrights or other law(s) or any other liabilities arising from reproduction of their supplied images.
Ownership and Reprints: All Heritage PhotoArt™ works are Copyrighted “©” by Heritage PhotoArt, LLC and the customer may not reproduce them in whole or in part for any reason. Heritage PhotoArt will make additional Editions of Limited signed copies of a customer’s particular PhotoArt according to the price/quantity list in effect at the the time of the reorder. We like to reserve the right to use any customer’s PhotoArt only to market our services (customer names abridged) by posting samples on our internet site and/or through any other film, print, trade show or visual media.
Privacy/Security: Heritage PhotoArt, LLC respects and does the utmost to protect the privacy of every customer. We never share or sell customer information. We do not harvest internet customer information. We will only send requested replies, reminders or optional follow-up service questionnaires. We will never identify customers on our website or in promotions. (We will even abridge identification details on any PhotoArts used to visually promote our services.) All customer financial information including credit card numbers is held for the short term on a system with no internet access and then after receipt of payment and close of the order immediately purged. American Express protects us all from misuse of their services, it is the reason why we partner with them to give you the peace of mind that your experience with us is safe and secure.
Shipments: Heritage PhotoArt, LLC has not missed a delivery deadline yet. Depending upon your requirements, deadlines, and location, Heritage PhotoArt, LLC will ship a customer’s Limited Edition PhotoArts™ via FedEx Ground standard, second day or FedEx overnight to ensure economical and on-time delivery. We will advise you via email of your order’s shipment and tracking number and follow up to guarantee safe receipt by you.
Warranty: Heritage PhotoArt, LLC warranties all prints against defects in workmanship. We furthermore guarantee prints will not fade for a period of 50 years if the prints were sold framed by us under glass or UV inhibiting plastic. You may have other warranty rights depending on which state you live in, and local laws.
Disputes: All legal issues, disputes and questions arising from or related doing business with Heritage PhotoArt, LLC shall be decided according to the laws of the state of Connecticut. These Terms and Conditions constitute the entire agreement between you, the customer, and Heritage PhotoArt, LLC and no other terms and conditions apply unless confirmed in writing only by the ownership of Heritage PhotoArt, LLC.
